SWITZERLAND - Defence of banking secrecy

The chairman of the Swiss Bankers Association has made an outspoken defence of Switzerland's banking secrecy practices. He also criticised Germany's "worrying precedent" of buying stolen information about the clients of a Liechtenstein bank.


 
EUROPE - EC acts against members' unfair tax rules

The EC has announced legal measures against several EU member states for discriminatory taxation:

The UK received a final warning over its failure to grant cross-border corporate loss relief, despite being ordered to do so by the European Court of Justice in the Marks & Spencer case.
Portugal is being taken to the ECJ for taxing non-resident service provider firms more than it taxes local companies.
Ireland received a final warning for taxing interest from foreign gilts while allowing tax relief on Irish-issued gilts.
Sweden received a final warning to stop imposing an exit tax on companies that desert Sweden for another member state.
Poland has been told to stop penalising pension funds for investing in foreign assets.
Greece has been told to stop giving permanent residents preferential tax treatment over foreigners when making a first-time residential property purchase.


 
EUROPE - EC presses on with new savings directive

The European Commission will in November put forward a proposed rewrite of the EU Savings Directive, intended to stop investors hiding assets in unregulated trusts. According to Reuters, it will require investment funds to disclose to the tax authorities information extracted from investors under anti-money laundering laws.


 
CAYMANS - New regulations for private trust companies

The Cayman Islands Cabinet has issued regulations introducing an "exemption-plus" regime for private trust companies (PTCs). All PTCs must in future be incorporated in Cayman, and must maintain their registered office with a licensed trust company where up-to-date copies of all trust deeds must be kept. PTCs must also register with the regulator and provide an annual declaration.


 
NEW ZEALAND - Government plans deferral of inheritance tax charge

The New Zealand government is to change the law so that the death of a spouse does not give rise to an immediate tax charge on the survivor, says Tax-News.
